On June 11, 2017, the Law of Ukraine "On the Electricity Market" dated April 13, 2017 No. 2019-VIII entered into force
(hereinafter referred to as the Law), thereby starting the process of reforming the electricity industry in Ukraine. The changes provided for by the Law are aimed at creating new opportunities and benefits for consumers of electricity.
One of the main stages of the reform is the separation of the function of distribution of electric energy from the functions of production, transmission and supply, that is, the creation of corresponding separate legal entities.
On January 1, 2019, the first stage of the state reform of the electricity market began in Ukraine in order for it to start working according to the European model. Therefore, from the beginning of 2019, energy services will be provided to consumers in Ukraine by two different companies. The operator of the electric energy distribution system, to whose networks the consumer is connected and the supplier company chosen by the consumer himself. These are two independent companies - with different call centers, accounts and licenses.
Previously, the functions of distribution and supply of electricity were concentrated in one company. European experience shows that when functions are divided between two independent companies, the system works faster and is more convenient for the consumer. Each company is focused on its tasks, serves consumers better and more quickly.
Provider functions:
  • supplies electricity to consumers,
  • serves consumers in matters of billing and cost calculations and payment terms, correctness of electricity calculations,
  • records meter readings,
  • provides additional services to consumers.
Functions of the distribution system operator:
  • responsible for the quality and reliability of electricity supply,
  • manages the distribution system,
  • operates and repairs power lines, substations and other energy facilities,
  • connects/disconnects from the distribution system (lines),
  • installs electricity meters and records their readings.
The procedure for changing the electricity supplier at the initiative of the consumer is provided for in Clause 6.1 of the Rules of the Retail Electricity Market, approved by the Resolution of the National Energy Regulatory Commission of Ukraine No. 2002 of 12.21.2018.
6.1.1. The consumer has the right, in accordance with the procedure established by these Rules, to change the electricity supplier by concluding a new contract for the supply of electricity to the consumer (supply of electricity by a universal service provider) with a new electricity supplier.
6.1.2. The process of changing the electricity supplier by the consumer is provided by subjects (participants) of the electricity market and participants of the retail electricity market, which are involved in the process of changing the electricity supplier and ensure the change and information exchange during such a change on a free basis.
6.1.3. The change of electricity supplier at the initiative of the consumer must be completed within the period starting from the day the consumer notified the new electricity supplier of the intention to change the previous electricity supplier, but within a period not exceeding 21 calendar days from the date of the specified notification.
The date of notification by the consumer of the intention to change the electricity supplier is considered to be the date of the recorded appeal of the consumer to the new electricity supplier regarding the intention to conclude a contract with him on the supply of electricity to the consumer.
If the consumer has a valid contract for the supply of electric energy to the consumer with a fixed term (term) of validity, in order to avoid fines for early termination of the contract by the previous
of the electricity supplier, the consumer must notify the new electricity supplier of the intention to enter into a contract with him on the supply of electricity to the consumer 21 calendar days before the expiration date of the current contract.
6.1.4. Within one procedure of changing the electricity supplier by the consumer in accordance with the procedure defined by this section, it is possible to change only one electricity supplier. At the same time, the consumer can initiate several procedures for changing the electricity supplier at the same time.
6.1.5. The notification of the intention to conclude a new contract with a new electricity supplier is submitted in the form of an application for joining the contract for the supply of electricity to the consumer on the terms of the published commercial offer of the electricity supplier, and if the parties have reached a mutual agreement to conclude the contract on terms that are not contained in the published commercial offers of the electricity supplier, in the notification about the intention to conclude a new contract with a new electricity supplier, the consumer must provide the new electricity supplier with additional information specified by the Procedure.
Commercial offers
The price for electricity effective from January 1 during the calendar month is determined separately for:
Consumers of group "a", whose accounting unit is equipped with an interval counter (s), built-in or external devices that provide the possibility of remote reading of the results of measurement of accounting data, hourly or shorter integration period:
  • under the condition of uniform consumption during the day.
  • with "normal" single-shift consumption of electrical energy.
  • with "normal" two-shift consumption of electrical energy.
Consumers of group "b", whose metering unit is equipped with non-interval (integral) electric energy meters and for which there is no possibility of remote reading of the results of the measurement of the hourly or shorter period of integration of the recorded data of the meters.
Depending on the method of payment acceptable to the consumer (advance payment, in fact, scheduled payments) and the method of payment for electricity distribution services (through the electricity supplier with the subsequent transfer of this payment by the electricity supplier to the system operator or directly to the distribution system operator), and the daily consumption schedule, which the OSR is calculated in accordance with the calculation procedure adopted by the NCRECP, an individual commercial offer is provided.
